Terms of Service

FlexMentor (the mobile app, this website and related services — together, the Service) is operated by Jabez Sanjay, an individual based in India (we, us). These Terms are an agreement between you and us. By creating an account, accepting an invite, or using the Service, you agree to them. If you don't agree, please don't use the Service.

Our Privacy Policy explains how we handle personal data and forms part of these Terms.

FlexMentor is software for online fitness coaching. There are two kinds of account:

• Coaches sign up themselves, set up a coaching profile, add clients, write workout and nutrition plans, review check-ins and message their clients.
• Clientsare added by a coach and activate their account from an emailed invite. They follow their coach's plans, log workouts, meals, weight and progress photos, submit check-ins and message their coach.

We provide the tool. We are not a party to the coaching relationship: we don't employ, vet or endorse coaches, and we don't supervise the advice they give.

You must be at least 18 years old and able to enter into a binding contract under Indian law. FlexMentor is not designed for children, and coaches must not add anyone under 18 as a client.

You may not use the Service if we have previously suspended your account for breaking these Terms.

• Give accurate information and keep it up to date.
• Keep your password private. You're responsible for what happens under your account; tell us straight away at jabez@flexmentor.in if you think someone else has accessed it.
• One person per account. Don't share logins or create accounts on someone else's behalf without their permission.
• Client invite links are personal. If you receive one you weren't expecting, ignore it — or tell us.

Coaching people about their health is a responsibility. When you use FlexMentor as a coach, you agree that:

• You have each client's permission before adding them, and you only enter information about them that you need to coach them.
• The plans, nutrition targets, feedback and messages you give are your own professional advice, and you are responsible for them — including making sure they suit each client's health, injuries and medical conditions.
• You hold whatever qualifications, registrations or insurance the law or your clients expect, and you don't claim credentials you don't have.
• Your fees, contracts, refunds and invoices with clients are between you and them. FlexMentor doesn't process payments and isn't responsible for them.
• You treat client data confidentially and use it only to coach that client — not for marketing, resale or anything they haven't agreed to.

FlexMentor is not a medical service and nothing in it is medical advice. Talk to a doctor before starting a new exercise or nutrition programme, especially if you are pregnant, have a medical condition, take medication or have had an injury. Stop exercising and seek medical help if you feel pain, dizziness or shortness of breath.

Food and nutrition values come from public food-composition databases and are estimates. They can contain errors and won't match every recipe or portion. Weight trends, Volts, levels, streaks and badges are motivational features, not health assessments.

Don't use the Service to:

• break any law, or help someone else break one;
• harass, threaten, abuse or discriminate against anyone, or send spam;
• upload sexual content, or photos of anyone other than yourself without their consent;
• impersonate someone, or misrepresent your qualifications or relationship with someone;
• access accounts or data that aren't yours, probe or break our security, or overload our systems;
• copy, scrape, reverse-engineer or resell the Service, or use it to build a competing product, except where the law expressly allows it;
• upload malware or anything designed to harm devices or data.

Progress photos are for tracking your own body over time and are shared only with your coach. To report abuse or content that breaks these rules, email jabez@flexmentor.in.

You keep ownership of what you put into FlexMentor — plans, logs, check-in answers, photos and messages (Your Content). You give us a limited, worldwide, non-exclusive, royalty-free licence to store, process, display and transmit Your Content only to run, secure and improve the Service for you — for example, to show a client's logs to their coach. This licence ends when Your Content is deleted, except for copies we must keep by law or that remain in backups for a short time.

Content shared between a coach and client is visible to both of them. If a client leaves a coach or a coach removes a client, some shared history may remain visible to the other person as described in our Privacy Policy.

The Service — its software, design, the FlexMentor name and logo, the Momentum features, Volts, badge artwork and this website — belongs to us or our licensors. We give you a personal, non-transferable, revocable licence to use the app for its intended purpose while these Terms apply. Feedback you send us may be used freely to improve FlexMentor.

FlexMentor is in beta and is currently free for coaches and clients. Features may change, appear or be removed as we learn what works, and the Service may occasionally be unavailable.

We may introduce paid plans for coaches in future. If we do, we'll tell existing coaches at least 30 days before any charge applies, and you can choose not to continue. Clients use FlexMentor through their coach and are not charged by us.

If you downloaded the app from Apple's App Store or Google Play, their terms also apply to the download. These Terms are between you and us only — not Apple or Google. Apple and Google have no obligation to provide maintenance or support for the app and are not responsible for claims relating to it (such as product liability, legal compliance or intellectual-property claims). Apple and its subsidiaries are third-party beneficiaries of these Terms and may enforce them against you as they relate to the iOS app.

We use trusted providers to host and run the Service; they are listed in our Privacy Policy.

You can stop using FlexMentor at any time and ask us to delete your account — see Delete your account.

We may suspend or close an account that breaks these Terms, puts other users or the Service at risk, or where the law requires it. Where it's reasonable, we'll warn you first and give you a chance to fix the problem. If we ever shut FlexMentor down, we'll give at least 30 days' notice so coaches and clients can save what they need.

We work hard to keep FlexMentor reliable and secure, but it is provided “as is” and “as available”. To the extent the law allows, we don't promise that the Service will be uninterrupted, error-free, or that it will produce any particular fitness, weight or health result. Results depend on you, your coach and many things outside our control.

To the extent the law allows:

• we are not liable for indirect or consequential losses, such as lost profits, lost business, or loss of data you could have backed up;
• we are not liable for advice, plans or conduct of coaches or clients, or for injuries arising from exercise or diet;
• our total liability to you for all claims relating to the Service is limited to the greater of the amount you paid us in the 12 months before the claim, or ₹1,000.

Nothing in these Terms limits liability that can't be limited by law, including for fraud, or for death or personal injury caused by our negligence.

If you're a coach, you agree to cover our reasonable losses and costs from claims by your clients or others that arise from your coaching, your advice, or your breach of these Terms or the law.

We may update these Terms as FlexMentor grows or the law changes. For material changes we'll tell you in the app or by email before they take effect. The date at the top shows the latest version. If you keep using the Service after a change takes effect, the new Terms apply; if you don't agree, you can delete your account.

These Terms are governed by the laws of India. If something goes wrong, please email jabez@flexmentor.infirst — most problems can be fixed quickly. Any dispute we can't resolve together will be subject to the exclusive jurisdiction of the competent courts in India. If any part of these Terms is found unenforceable, the rest still applies.

Under the Information Technology Act, 2000 and the rules made under it, our Grievance Officer for complaints about the Service or content on it is:
