Terms of Service

By downloading, installing, or using the FlexMentor mobile application ("App") or any related services (collectively, "Services"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree to these Terms, do not use the App.

These Terms constitute a legally binding agreement between you and FlexMentor ("we", "our", or "us"). We reserve the right to update these Terms at any time. Your continued use of the App following any updates constitutes your acceptance of the revised Terms.

You must be at least 13 years old to use FlexMentor. Users between 13 and 18 must have verifiable parental or guardian consent.

FlexMentor is a two-sided fitness coaching platform that connects personal trainers ("Coaches") with their clients ("Clients"). The App provides tools for workout plan management, nutrition planning, progress tracking, check-in submissions, and real-time messaging.

FlexMentor is available on iOS (App Store) and Android (Google Play). The App is built on Expo and React Native and is accessible only on supported mobile devices.

To access the App, you must create an account. You agree to:

• Provide accurate, current, and complete registration information.
• Maintain the security of your password and account credentials.
• Immediately notify us of any unauthorized access to your account.
• Accept responsibility for all activities that occur under your account.

You may not create an account on behalf of another person without authorization. You may not share your account credentials with others. FlexMentor reserves the right to suspend or terminate accounts that violate these Terms.

Coaches

If you register as a Coach, you represent that you have the qualifications, experience, and authority to provide fitness and nutrition guidance to your clients. You acknowledge that:

• FlexMentor is a technology platform and does not employ, endorse, or certify Coaches.
• You are solely responsible for the accuracy, safety, and appropriateness of any workout or nutrition plans you create and assign.
• You are solely responsible for your client relationships, communications, and any coaching advice provided.
• You agree not to provide medical diagnoses, prescribe medications, or offer services outside your professional scope.

Clients

If you register as a Client, you acknowledge that:

• Fitness and nutrition plans provided through the App are not a substitute for professional medical advice.
• You should consult a qualified healthcare provider before starting any new fitness or nutrition program.
• You exercise or follow nutrition plans at your own risk.
• FlexMentor is not responsible for the conduct or advice of any Coach on the platform.

You agree not to use FlexMentor to:

• Violate any applicable law, regulation, or third-party rights.
• Upload or transmit content that is harmful, abusive, harassing, defamatory, obscene, or otherwise objectionable.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Interfere with, disrupt, or attempt to gain unauthorized access to any part of the App or its infrastructure.
• Use automated means (bots, scrapers) to access or collect data from the App.
• Reproduce, distribute, or create derivative works from the App without our prior written consent.
• Use the App for any commercial purpose outside of the intended coach–client relationship.
• Upload content that infringes any intellectual property right.

You retain ownership of all content you submit to FlexMentor, including workout plans, nutrition plans, messages, progress photos, and check-in data ("User Content").

By submitting User Content, you grant FlexMentor a limited, non-exclusive, royalty-free license to store, display, and transmit your content solely to operate and provide the Services. We will not use your User Content for marketing or advertising without your explicit consent.

You represent and warrant that you own or have the necessary rights to all User Content you submit, and that such content does not violate these Terms or any applicable law.

FlexMentor reserves the right to remove any User Content that violates these Terms without prior notice.

All intellectual property rights in the App, including but not limited to software, design, logos, trademarks, and content created by FlexMentor, are owned by or licensed to FlexMentor.

You are granted a limited, non-exclusive, non-transferable, revocable license to use the App solely for your personal, non-commercial use in accordance with these Terms.

"FlexMentor" and the FlexMentor logo are trademarks of FlexMentor. You may not use our trademarks without our prior written consent.

The App is provided "as is" and "as available" without any warranties of any kind, either express or implied.

To the fullest extent permitted by law, FlexMentor disclaims all warranties, including but not limited to:

• Implied warranties of merchantability and fitness for a particular purpose.
• Warranties that the App will be uninterrupted, error-free, or secure.
• Warranties regarding the accuracy or completeness of any content.
• Warranties regarding the qualifications or conduct of any Coach using the platform.

To the maximum extent permitted by applicable law, FlexMentor and its officers, directors, employees, and agents shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss of data, profits, revenue, or business.
• Personal injury or property damage arising from your use of the App.
• Any errors or omissions in any content.
• Unauthorized access to or alteration of your data.

In jurisdictions that do not allow the exclusion of certain warranties or limitation of liability, FlexMentor's liability is limited to the maximum extent permitted by law.

FlexMentor is a fitness coaching platform and does not provide medical advice, diagnosis, or treatment. Content on the platform, including workout plans and nutrition guidance, is for informational and coaching purposes only.

Before beginning any exercise program or making significant changes to your diet, consult a qualified physician or healthcare provider, particularly if you have pre-existing medical conditions, are pregnant, or have been previously inactive.

You participate in all fitness activities at your own risk. FlexMentor expressly disclaims all liability for injuries, health complications, or any other adverse outcomes arising from your use of the App.

You may terminate your account at any time by deleting it within the App or contacting us at jabez@flexmentor.in.

FlexMentor reserves the right to suspend or permanently terminate your account at any time, with or without notice, for conduct that we believe violates these Terms, is harmful to other users, or is otherwise objectionable.

Upon termination, your right to use the App ceases immediately. Provisions of these Terms that by their nature should survive termination (including intellectual property, disclaimers, and limitation of liability) shall survive.

If you downloaded FlexMentor from the Apple App Store, the following additional terms apply:

• These Terms are between you and FlexMentor only, not Apple Inc. Apple is not responsible for the App or its content.
• Apple has no obligation to provide maintenance or support for the App.
• In the event of any failure of the App to conform to any warranty, you may notify Apple for a refund (if applicable); Apple has no other warranty obligation with respect to the App.
• Apple is not responsible for addressing any claims relating to the App or your use of it.
• Apple is a third-party beneficiary of these Terms and may enforce them against you.

If you downloaded FlexMentor from the Google Play Store, Google LLC is not a party to these Terms and has no responsibility for the App.

These Terms are governed by and construed in accordance with applicable law, without regard to conflict of law principles.

Any dispute arising out of or relating to these Terms or the App shall first be attempted to be resolved through informal negotiation by contacting us at jabez@flexmentor.in. If not resolved within 30 days, disputes shall be submitted to binding arbitration.

You agree that any claims will be brought in your individual capacity and not as a class action or collective proceeding.
